These terms and conditions (the "Terms") are the terms which apply when you access the website www.theperfumestudio.com (the "Website") or place orders to purchase any of the products made available to you on the Website. Any reference to "we"/"us"/"our" in these Terms is a reference to The Perfume Studio Limited (12525453) and any reference to "you"/"your" means you, the user of the Website.

Our agreement

You use of this Website and purchase of any of the products on the Website means you agree to be bound by these Terms. If you do not agree to these Terms, please do not access nor use the Website. 

We recommend that you print a copy of these Terms or save them to your computer for future reference. These Terms are only available in the English language.

The Perfume Studio Limited reserves the right to change or modify these Terms from time to time and changes will be notified via publishing on the website. It is your responsibility to check for such changes. If you do not wish to accept the new Terms you should not continue to use the Website. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms.

Eligibility to purchase

To be eligible to purchase goods on this Website and lawfully enter into and form contracts under English law, you must be:

  • at least 18 years old.
  • resident in the United Kingdom or Ireland. Only orders with a billing and delivery address within the United Kingdom or Ireland will be processed.

Registering for an account

We offer you the opportunity to register for a personal account (access to our membership). If you take advantage of this opportunity any personal data that you provide us with during the registration process will be stored in our database.

You must provide the following information when you register: your name, email, password, billing address and, where applicable, different delivery address. You can access, update or correct your personal account details via the ‘My Account’ button at any time. We will only use the stored data in accordance with our Privacy Policy.

You warrant that the personal information you provide when you register is true, accurate, current and complete in all respects and you are not impersonating any other person or entity.

You are responsible for maintaining the confidentiality of your password and user name and are responsible for all activities that are carried out under them. We do not have the means to check the identities of people using the Website and will not be responsible for losses suffered by you where your password or user name is used by someone else unless this is due to our negligence. You agree to notify us immediately here if you become aware or suspect any unauthorised use of your password or username.

Indemnity

You agree to defend, indemnify and hold The Perfume Studio Limited harmless for any loss, damages or costs, including reasonable legal fees, resulting from any third party claim, action, or demand resulting from your use of the Site. You also agree to indemnify us for any loss, damages, or costs, including reasonable legal fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

Our products, images and descriptions

We will take all reasonable care to ensure that all details, descriptions, images and prices of products appearing on the Site are correct. However, to the extent permitted by applicable law, we do not warrant that the product descriptions, colours or other content available on the Website are accurate, complete, reliable, current, or error-free. Although we aim to keep the Website as up to date as possible, the information including product descriptions appearing on this Website at a particular time may not always reflect the product exactly at the moment you place an order.

The photographs that illustrate the Products do not fall within the scope of the Contract and The Perfume Studio Limited’s liability may not be incurred in connection with any such error.

While every effort is made to ensure that the colour of products for which photos are displayed on the Website is an accurate representation of the originals, variations may occur, in particular due to technical limitations in reproducing colour using information technology (screen brightness and monitor quality for instance).

Consequently, The Perfume Studio Limited may not be held liable for errors or inaccuracies in photographs or graphics showing products that are presented on the Website. For example the packaging of the Products may vary from that shown on images on our Website.

Experience venues and session lengths

Experience and session lengths (when given) are approximate, and vary from venue to venue. These are given simply as an indication of the time you will spend at the venue. Unless stated otherwise, you will be in a group and there may be waiting time involved. We provide itineraries and event locations on the Website as a guide only and the running order of an event may change. We reserve the right to amend these without prior notice, and we will contact you with the new details. If this is not deemed acceptable you have the option to cancel and book to the same cash value. 

Products are offered subject to availability

If we are unable to supply you with a Product, for example because that Product is not in stock or no longer available because of an error in the price on our Website, your order will not be processed. If you have already paid for the Product, we will refund you the full amount of the Product as soon as possible. If we are unable to supply the whole order, we will also refund any delivery costs charged as soon as possible.

No substitute Product will be sent to replace the unavailable Product. The Perfume Studio Limited may not be held liable if Products are out of stock or unavailable.

Experiences are offered subject to availability. If we are unable to accommodate you with venue or location, for example because that venue is fully booked we will offer you an alternative date or venue.

How the contract is formed between you and us

All orders and bookings are subject to availability and acceptance by us. We reserve the right to refuse to accept an order. After placing an order, you will receive an email from us acknowledging that we have received your order.  All communications will be addressed to the email address you supply when you register. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product.

Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each stage of the process.

You will automatically be sent an email confirming receipt of your order with a summary of the details of your order which we recommend that you print out and keep for your own records. The confirmation email does not constitute our acceptance of your order. Unless we have notified you that we do not accept your order or you have cancelled your order in accordance with the Cancellation section of the Terms, our acceptance of your order and the completion of the contract between you and us will take place when we have dispatched the Products ordered to you. The contract between us will only be formed when we dispatch your order.

We may refuse to accept your order if an item you have ordered is out of stock, we are unable to obtain authorisation for your payment, if we suspect fraudulent activity or violation of these Terms (including our Privacy Policy) or if we identify a product or pricing error. If we do not accept your order for any of the above reasons, we will contact you by email or telephone advising you of this.

Experience and gift voucher validity

The Perfume Experience and Gift Vouchers are normally valid for 12 months from the date of purchase (some promotional vouchers may have longer or shorter validity but the exact expiry date will be printed on the voucher). You must make your booking before this expiry date or the voucher will no longer be valid. (The participation date for an experience can be later than this)

If an Experience has not been booked by the expiry date shown, that Experience Voucher will cease to be valid. 

Experience Voucher bookings

Our Flagship events are run by The Perfume Studio Limited. Bookings for our Fragrance Experiences can be made online or by phone with us.

However rare, the venue or Perfume Stylist may need to cancel the Experience at short notice for reasons beyond their control, such as illness or mechanical breakdowns. We will do our best to contact you as quickly as possible should this happen.  We regret that in the event of cancellation, The Perfume Studio Limited is unable to reimburse travel, accommodation or any other expenses you may incur in relation to the cancelled Experience.

With the exception of Force Majeure, If we are forced to cancel an Experience, Class or Event, we will offer you the following options:

  • Accept the changed arrangements (an alternative date/time/location etc)
  • Purchase alternative arrangements from us, any difference in cost will either be charged to you or credited to your account.  This will mean paying more if it is more expensive or receiving a credit to your account if it is less.
  • If your preferred location is withdrawn, you will be offered alternative venues wherever possible. Where locations are stated as ‘UK wide’, locations may be limited in some areas.

Please note the above options are not available where any change made is a minor one. Except as otherwise expressly set out in these booking conditions our liability for significant changes and cancellations is limited to the above mentioned options.

Very rarely, after your Experience has commenced we or our suppliers may be forced by Force Majeure to change or cancel part or all of your Experience. If this does happen then we regret that we will be unable to provide any refunds pay you any compensation or meet any losses or expenses you or any guest(s) incur as a result. We will try to assist you to secure alternative arrangements but you will have to pay any associated and/or additional costs in doing so and arising out of the alternative arrangements.

Changes and cancellations by you (Experience Voucher Bookings and Direct Bookings)

If you wish to change your booking in any way we will try to comply with your requests but we cannot guarantee that changes can always be made. Should you be unable to attend your experience (whether booked via an Experience Voucher, Gift Voucher or Direct Booking) as booked for any reason we require a minimum of 7 days notice in order to avoid re-booking fees. If your booking includes afternoon tea this is non transferable within 14 day of the booking. Our standard re-booking fee is £25/pp for the perfume class and £35/pp for afternoon tea. We cannot offer refunds on experiences if you are simply no longer able to attend.

Private Party/Corporate Experience Event bookings

These events are normally run by The Perfume Studio Limited. Bookings for our private events are made directly with us in writing by email or by phone.

However rare, the venue or Perfume Stylist may need to cancel the Experience at short notice for reasons beyond their control, such as illness or mechanical breakdowns. We will do our best to contact you as quickly as possible should this happen.  We regret that in the event of cancellation, The Perfume Studio Limited is unable to reimburse travel, accommodation or any other expenses you may incur in relation to the cancelled Experience.

If we have to cancel an Experience or Event, we will offer you the choice of the following options:

  • Accept the changed arrangements
  • Purchase alternative arrangements from us, of a similar standard to those originally booked if available. You must pay the applicable price of any such arrangements. This will mean paying more if it is more expensive and receiving credit to your account if it is less.

Please note the above options are not available where any change made is a minor one. Except as otherwise expressly set out in these booking conditions our liability for significant changes and cancellations is limited to the above mentioned options.

Our events are run by fully trained Perfume Stylists. 

Very rarely, after your Experience has commenced we or our suppliers may be forced by Force Majeure to change or cancel part or all of your Experience. If this does happen then we regret that we will be unable to provide any refunds pay you any compensation or meet any losses or expenses you or any guest(s) incur as a result. We will try to assist you to secure alternative arrangements but you will have to pay any associated and/or additional costs in doing so and arising out of the alternative arrangements.

Changes and cancellations by you (Private Party/Corporate Experience Event bookings)

If you wish to change your booking in any way we will try to comply with your requests but we cannot guarantee that changes can always be made. Where a change can be made, we will not charge an amendment fee however you will be charged for any extra costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers.

For private group events, if you wish to cancel all or any part of your booking, you should advise us immediately by telephone followed by confirmation in writing. We will make a cancellation charge on the scale shown. Charges are based on the estimated losses and expenses we may incur should we be unable to withdraw from our obligations with our suppliers.

If you cancel your event:

  • Over 10 days from the event: 25% (The Deposit) of the total cost of the agreed event in question.
  • 0-9 days from the event: 100% of the total cost of the event in question.

Returns and refunds

Where you have purchased as a consumer, you have certain rights under the law. These include:

  • that any products (including Gift Vouchers and Experience Vouchers) supplied by us will be of satisfactory quality, fit for their intended purpose and will conform to any description given on this Website;
  • certain remedies if a product is defective; and
  • a right to cancel your order within 14 working days, beginning the day after the day on which you receive the product, and to receive a full refund, even if the product is not defective. This right is subject to certain conditions and exceptions (see ‘Return of non-faulty goods’).

To cancel a Contract, you just need to let us know in writing that you have decided to cancel. The easiest way to do this is to complete our contact form. If you use our online form, we will email you to confirm we have received your cancellation. You can also write to us at: The Perfume Studio, 72a Windsor Street, Beeston, Nottingham, NG9 2BW.

If you are emailing us or writing to us, please include details of your order to help us to identify it, please include your order reference number. If you send us your cancellation notice by email or post, then your cancellation notice is effective from the date you send us the email or post the letter to us. For example, you will have given us notice in time as long as you get your letter into the last post on the last date of the cancellation period or email before midnight on that day.

This cancellation right does not apply in the case of sealed goods if they have become unsealed after delivery unless the product is defective.

Goods, including free gifts selected as part of a promotion, should be returned as close as possible to their original unused condition.

Please return all unused goods / Experience or Gift Vouchers to: The Perfume Studio Returns, 72a Windsor Street, Beeston, Nottingham, NG9 2BW.

Return of non-faulty goods

We hope you will be happy with your purchase from us, however if not, you have the right to return the product to us and receive a full refund, provided that you:

  • notify us in writing that you are cancelling your purchase no later than the 14 working days after the day on which you received your product;
  • have taken reasonable care of the product prior to return and they/it have not been damaged;

You will be responsible for the cost of returning the product to us, unless it is faulty, incorrect or not as described.

Please return the Product accompanied by a copy of your order in suitable packaging to ensure it reaches us in acceptable condition.

We will refund the purchase price and original delivery charge of any goods returned no later than 14 days from the day when you give us notice of cancellation. We will refund you using the same means of payment you used for the initial transaction, unless expressly agreed otherwise.

Please note that if you fail to take reasonable care of returned products, or fail to return the product to us, we will be entitled to make a claim against you for any losses which we suffer.

The right of cancellation can only be exercised by you, the purchaser of the Product, and not by a third party.

Prices, delivery charges and payment

The prices of the product are given in pounds sterling and are inclusive of VAT (where applicable, unless otherwise stated) at the current rates.

The prices are exclusive of delivery charges. The total cost of your order is the price of the products ordered and delivery charges as set out in the Delivery section of the Terms. Delivery costs will be specified to you before the order is confirmed and when the order is definitively validated.

The price invoiced to you is the price stated on the order confirmation sent via email by The Perfume Studio Limited.

You accept The Perfume Studio Limited's right to modify our prices at any time; however the Products will be invoiced on the basis of the tariffs in force when the order is recorded, subject to the availability of such Products. The tariff in force is that stated on the Website, unless there is a typographical error.

Our site contains a selection of products and it is always possible that, despite our reasonable efforts, some of the Products on our website may be incorrectly priced. If we discover an error in the price of the Products you have ordered, we will contact you to inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price.

All payments must be made immediately over the Internet. Unless the server is unavailable, you may pay with a credit or debit card or with PayPal.

You will need to enter the card number, expiry date, name of cardholder and the 3-digit security code from the back of the card.

For your security our website transactions are carried out in a secure environment via our payment service provider, Stripe. Stripe is fully approved to Level 1 in the Payment Card Industry Data Security Standards (PCI DSS SaferPayments programme), which is the highest level of compliance.

As part of the fight against online fraud, information concerning orders will be checked by The Perfume Studio Limited’s designated Payment Service Provider, Stripe (Shopify).

Competitions, offers and promotions

From time to time The Perfume Studio Limited may run competitions, offers and promotions via the Website. Separate terms and conditions are applicable governing these. Please take the time to read our terms and conditions for our offers and promotional codes, as it includes important information and further terms, which apply to you.

Delivery

We accept orders for the UK and Ireland only. Delivery will be made to the address provided by you when you place your order and cannot be changed once received.

The estimated time for you to receive an order is as follows:

  • For the UK, will be posted via Royal Mail which will take 3-7 working days. 
  • This excludes personalised products, which have a 7-day lead time before dispatch.

In any event, orders are delivered at the latest thirty (30) days after you place your order. If we are unable to dispatch the product within that time we will email to let you know and to give you an estimated delivery date. In these circumstances you have the right to cancel the order and receive a full refund.

Last order dates, delivery times, opening hours and courier charges may change over the Christmas and New Year period. For seasonal variations see our website homepage or get in touch Customer Service Team.

The Perfume Studio Limited will not be liable or responsible if your delivery is affected by an event outside our control including in the event of overly long delivery time caused by the transportation services, and in the event of the loss of the Products ordered. If a delivery is late, you must inform the Customer Service Team as soon as possible. The Perfume Studio Limited will then contact its chosen carrier in order to initiate an enquiry. Enquiries may take some time.

As soon as the product is delivered to you, you are responsible for it.

We want you to be happy with your purchase from us. If you are unhappy with the product in any way, please contact our Customer Service Team within 14 days of receiving your product to notify us.

Behaviour

We or any person in authority can terminate your Experience if your behaviour or that of any participant of your group booking is likely in the reasonable opinion of ourselves or any person in authority to cause distress, damage, danger or annoyance to other customers, other guests, employees, property or anyone else or appears to be unfit to participate in the Experience.

In this situation you, or the guests concerned will not be able to complete the Experience and we will not be liable for any refund, compensation or any expenses or costs incurred as a result. We cannot accept liability for the behaviour of others in your group, the members of the booking are your responsibility and any persons behaving in an undesirable manner will be removed as a result of their action. We will not be liable for any refund, compensation or any costs that may be incurred as a result.

You understand and agree that when you book through us, you accept responsibility for the decent conduct of yourself and all guests during the Experience.

We and any other supplier reserve the right within our/their reasonable opinion to terminate the Experience in question of any members due to misconduct. Full payment for any damage or loss (reasonably estimated if not precisely known) caused by you or any member of your party must be made direct to the accommodation owner or manager or other supplier or to us as soon as possible.

You will also be responsible for meeting any claims subsequently made against us or any of our suppliers and all costs incurred by us / the supplier (including our own, the supplier’s and the other party’s full legal costs) as a result of your actions.

You agree to ensure that you and all members of your group act at all times in a safe responsible manner and comply with all safety procedures, listen and be present at all safety and information briefings, make supervisors or any persons in authority immediately aware of any equipment or site deficiencies or concerns and obey all laws, requests, conditions of use of any supplier, including entertainment venues.

Complaints procedure

We welcome your feedback on all of our products and services. If you have a problem or complaint about a product please get in touch within 14 days of receiving your order. If you have a complaint about an experience, please bring it to the attention of your Perfume Stylist at the venue as soon as possible, so that they have a chance to put matters right. If your concern is not resolved on the day, please get in touch with our Customer Service Team within 14 days of your Experience date stating; your voucher or booking reference, participant and venue details (and Perfume Stylist details), and we will be happy to investigate further. 

Please bear in mind, that in general, we consider it unreasonable if you take no action during an Experience, but then make a complaint at a later date.

Force majeure

Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by Force Majeure. Additionally we cannot accept liability or pay any compensation where you/any guest(s) suffer any damage, injury, expense or loss of any description as a result of Force Majeure.

Safety standards

Please note it is the requirements and standards of the country in which any services which make up your Arrangements which apply to those services and not those of the UK. As a general rule, these requirements and standards will not be the same as the UK and may sometimes be lower.

Health

If you (or any guests on your booking if for more than one person) have an existing medical condition, allergies or disability which may affect the suitability for the Experience you must let us know the details of such condition(s) before you make your booking, so we may do our best to accommodate where possible.

If in our reasonable opinion we believe that your chosen Experience is not suitable for the individuals concerned taking into account their medical condition or disability, it is reasonable for us to refuse to accept the booking.

If we find out after you have made the booking that a member of the booking has an existing medical problem or disability and is not being accompanied by someone who could provide all the assistance required and you have failed to give us this information at the time of booking, we reserve the right to cancel the booking and impose any cancellation charges. If you would like to discuss specific need please get in touch with our Customer Service Team. 

Inclusivity

We welcome the participation of disabled people in our experiences. We are committed to ensuring that disabled customers are given every opportunity to participate, so we ask that you tell us about any relevant disability at the time of ordering. This enables us to do our best to meet the participant’s particular needs. We will be happy to provide information about the disabled facilities available at specific venues on request. 

Our liability

We accept liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents.

You have certain rights under the law. These include that any products supplied by us will be of satisfactory quality and fit for their intended purpose. Nothing in these Terms is intended to affect these statutory rights. For more information about your statutory rights contact your local Citizens Advice Bureau or Trading Standards Office.

If we breach these Terms we shall only be liable for losses which are a reasonably foreseeable consequence of such a breach, up to a maximum of the purchase price of your order. Losses are foreseeable where they could be contemplated by you and us at the time of entering into this agreement.

Information provided about the products, is intended for the use of educational or informational purposes only. The statements and products are not intended to diagnose, treat, cure or prevent any condition or disease. Please consult with your own doctor or health care practitioner regarding the suggestions and recommendations made on the Website (where applicable).

With current technology it is not possible to develop and operate computer programs (software) and data processing systems (hardware) entirely without error, or to rule out any unpredictable events in connection with the internet. We provide no guarantee for the constant and uninterrupted availability of the Website.

We are not responsible for:

  • losses not caused by our breach;
  • indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us at the time of entering into this agreement, for example loss of profits or loss of opportunity;
  • failure to provide the Website or to meet any of our obligations under this agreement where such failure is due to Events Beyond Our Control.
  • "Events Beyond Our Control" means any cause beyond our reasonable control which prevents us from providing the Website or fulfilling any of our other obligations under this agreement and includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, terrorist activity and acts of God.

Where the Products have been purchased for commercial, business or resale purposes, we have no liability, howsoever arising, in respect of any express or implied condition, warranty or term, statement, representation whether statutory or otherwise, relating to the goods supplied. The buyer accepts that he is best placed to insure against losses which arise by virtue of any breach of this agreement and warrants that he carries adequate insurance in this respect.

Copyright and other intellectual property rights

Your use of the Website grants no rights to you in relation to copyright, design rights, trade marks or other of our intellectual property rights (or the intellectual property rights of third parties).

We provide the Website to you solely for your personal, non-commercial use. You may electronically copy and print only those areas of the Website which are required in the process of using the Website as a shopping resource. The content of the Website may not be used for any other purpose without our express written permission.

Severability

Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.

Waiver

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. These Terms and the order summary sent to you together form a contractual whole and constitute the entirety of the contractual relations between us.

Entire terms and conditions

These Terms form the entire basis of any agreement between us.

Terms and conditions of suppliers

Some of the services which make up your booking may be provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier's liability to you. Copies of the relevant parts of these terms and conditions are available on request from ourselves or the supplier concerned.

Rights of third parties 

We both hereby exclude any rights that any other party may have in relation to this Agreement under the Contract (Rights of Third Parties) Act 1999.

Law and jurisdiction

These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.

Your statutory rights are unaffected.
